1. Introduction

These terms of website use explain the rules for using the CarZoon website at https://carzoon.co.uk and any related CarZoon pages, account areas, Advert forms, advert tools, enquiry forms and online features that link to these terms (together, our site).

By using our site, whether as a visitor, private seller, dealer, business user, registered account holder or any other user, you confirm that you accept these terms and agree to comply with them.

If you do not agree to these terms, you must not use our site.

CarZoon is an online automotive marketplace and vehicle advertising platform. We provide website tools that help users browse vehicle adverts, publish adverts, contact sellers or dealers, and access related vehicle information. Unless we clearly state otherwise, CarZoon does not own, inspect, sell, buy, finance, insure, warrant, deliver or part-exchange vehicles advertised on the site.

2. Other terms and policies

Depending on how you use CarZoon, these terms apply with:

The site is operated by CarZoon Automotive Ltd, a private limited company registered in Scotland under company number SC882384. Our registered office is 5 South Charlotte, Edinburgh, Scotland, EH2 4AN, United Kingdom.

You can contact us by email at support@carzoon.co.uk. Dealer and business partner enquiries may also be handled through dealers@carzoon.co.uk where that address is displayed on the site.

Unless we clearly state otherwise in writing, CarZoon is not a vehicle retailer, lender, insurer, warranty provider, financial adviser, legal adviser, mechanical inspector or valuation professional.

4. Changes to these terms

We may update these terms to reflect law, regulation, security, marketplace risk or changes to the site. We will publish the updated version and its review date. Where a change materially affects an Account, paid service or continuing relationship, we will give reasonable notice through the site, Account or email where practicable.

A change will not remove a statutory right or retrospectively change a completed consumer purchase. If a material change requires consent or gives a right to cancel, CarZoon will explain that before it takes effect.

5. Changes to our site

We may update, improve, suspend, remove or change any part of our site, including features, adverts, account tools, search tools, dealer tools, pricing, Advert rules, vehicle data displays and third-party integrations.

We do not guarantee that any content on the site will always be accurate, complete, available, current or free from errors or omissions.

6. Accessing our site

We aim to keep the site available and secure, but maintenance, security incidents, third-party failures and events outside reasonable control can interrupt it. We do not promise uninterrupted or error-free access.

We may suspend, restrict, withdraw or change a feature where reasonably necessary for maintenance, security, legal compliance, safety or product operation. We will give reasonable notice where practicable, especially if an active paid service is materially affected. The applicable service terms and Refund and Cancellation Policy explain any remedy for a material CarZoon service failure.

You are responsible for your device, software, internet connection and proportionate security settings. The site is directed to the United Kingdom; a person accessing it elsewhere is responsible for applicable local law.

7. Age and authority

You must be at least 18 years old to create an account, submit a vehicle advert, contact a seller or dealer for the purpose of buying a vehicle, request a test drive, or use any paid service on the site.

If you use the site on behalf of a company, dealer, partnership or other organisation, you confirm that you have authority to bind that organisation and that it will comply with these terms.

8. Your account and password

If you create an account or are provided with a user ID, password, access link or other security information, you must keep it confidential and secure. You must not disclose it to any third party or allow anyone else to use your account.

You are responsible for all activity carried out through your account unless caused by our breach of duty. You must make sure your account information, contact details, business details and advert information are accurate and kept up to date.

We may disable, suspend or close any account, user ID, password or access right at any time if, in our reasonable opinion, you have failed to comply with these terms or any other applicable CarZoon terms or policies.

If you know or suspect that anyone else knows your login details or has unauthorised access to your account, you must promptly contact us at support@carzoon.co.uk.

9. Our role as a marketplace

CarZoon provides a platform for vehicle adverts and related enquiries. We are not normally a party to any sale, purchase, reservation, finance agreement, insurance contract, warranty contract, delivery arrangement, test drive arrangement or other transaction between users.

Vehicle adverts may be uploaded by private sellers, dealers, business users or by CarZoon staff on behalf of an approved user. Sellers and dealers are responsible for the accuracy, legality and completeness of their adverts and for ensuring that they have the right to advertise and sell the vehicle.

Buyers and visitors are responsible for making their own checks before relying on an advert, contacting a seller, viewing a vehicle, test driving a vehicle, paying a deposit or buying a vehicle. This includes checking the vehicle, ownership, mileage, MOT history, service history, accident history, outstanding finance, HPI or history reports, insurance, road tax position, ULEZ or clean air zone requirements, and any other relevant information.

Where we display vehicle information from public or third-party data sources, such as MOT, tax, mileage, emissions, ULEZ, valuation, history, finance, warranty or insurance information, this is provided for general information only and may be incomplete, delayed, inaccurate or subject to third-party terms.

10. Intellectual property rights

We are the owner or licensee of intellectual property rights in our site, including the CarZoon name, branding, logo, design, layout, software, databases, text, graphics, icons, images, documents, tools and other content created or provided by us.

All such rights are reserved. You may access and use the site for your own lawful personal or business use in accordance with these terms.

You may print or download reasonable extracts from the site for personal use, internal business reference or legitimate vehicle buying/selling purposes, but you must not modify those materials, remove notices, use our branding misleadingly, or use content from the site for unauthorised commercial purposes.

You must not copy, scrape, harvest, extract, reproduce, republish, sell, license, mirror, frame, reverse engineer, data mine or commercially exploit any part of the site, advert database or vehicle data without our prior written consent, except where permitted by law.

11. No reliance on information

The content on our site is provided for general information only. It is not intended to amount to legal, financial, insurance, tax, valuation, mechanical, safety, compliance or other professional advice.

You should obtain professional or specialist advice before taking, or refraining from taking, any action based on content on the site.

Although we make reasonable efforts to keep site information up to date, we make no representations, warranties or guarantees, whether express or implied, that site content is accurate, complete or up to date.

12. Responsibility and liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights, or another liability that cannot lawfully be excluded or limited.

CarZoon is responsible for loss or damage that is a foreseeable result of its breach of these terms or failure to use reasonable care and skill. CarZoon is not responsible for loss caused by a Seller, another user, inaccurate user-supplied information, a transaction to which CarZoon is not a party, or an event outside CarZoon's reasonable control, except to the extent that CarZoon's own breach or negligence caused or contributed to the loss.

If you use CarZoon as a consumer, we do not exclude rights or remedies provided by law. We are not responsible for business losses where the site is used for domestic or private purposes.

If you use CarZoon for business purposes, the more specific Dealer Terms or accepted service terms apply. To the extent permitted by law, CarZoon is not liable for indirect or consequential loss or for loss of profit, revenue, opportunity, goodwill or anticipated savings. Any specific financial cap must be stated in the accepted business service terms and will not apply to liability that cannot lawfully be limited.

13. Uploading adverts, images and other content

Whenever you upload or submit content to the site, including vehicle adverts, descriptions, images, videos, registration numbers, mileage, prices, business profile content, reviews, enquiries, documents or messages, you must comply with our Acceptable Use Policy and all applicable laws.

You confirm that any content you provide is accurate, lawful, not misleading, not fraudulent, not offensive, not defamatory, not discriminatory, does not infringe third-party rights, and that you have all permissions needed to provide it to us and allow us to use it on the site.

You remain responsible for your content. We may review, edit, reject, remove, suspend, hide or restrict content if we consider that it breaches these terms, our Acceptable Use Policy, any legal requirement, any third-party right, or the standards expected on CarZoon.

We may disclose your identity or relevant information to a third party, regulator, law enforcement authority, court or professional adviser where reasonably necessary to deal with a legal complaint, rights claim, safety concern, fraud concern, misuse issue or regulatory requirement.

You are responsible for keeping your own copies and backups of content you upload. We do not guarantee that user content will always remain available on the site.

14. Rights you licence to us

When you upload, submit or provide content to CarZoon, you retain your ownership rights in that content. However, you grant us a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to use, host, store, reproduce, display, publish, adapt, resize, crop, distribute, make available, promote and otherwise process that content for the purposes of operating, improving, moderating, protecting, marketing and promoting CarZoon and the relevant adverts, services and platform features.

This licence allows us to display your advert, images and related content on the site, in search results, on dealer profiles, in emails or notifications, on social media previews, in marketing materials and through technical service providers that help us operate the platform.

You also grant other users a limited right to view and use your content through the site for lawful vehicle browsing, buying, selling, enquiry and comparison purposes only.

15. Viruses, misuse and security

We do not guarantee that our site will be secure or free from bugs, viruses or other harmful material. You are responsible for configuring your device, software and security protections before accessing the site.

You must not misuse the site by knowingly introducing viruses, trojans, worms, logic bombs, malware, harmful code or other technologically harmful material. You must not attempt to gain unauthorised access to the site, accounts, servers, databases, systems or networks connected to the site.

You must not attack the site using a denial-of-service attack, distributed denial-of-service attack, automated scraping, credential stuffing, spam, phishing, data harvesting, vulnerability scanning, probing, crawling or any other activity that may damage, overload, disrupt or compromise the site or its users.

A breach of this section may constitute a criminal offence under the Computer Misuse Act 1990. We may report any such breach to relevant law enforcement authorities and co-operate with those authorities, including by disclosing your identity where permitted or required by law. Your right to use the site will cease immediately if you breach this section.

16. Linking to our site

You may link to our home page or to a public advert page in a way that is fair, lawful and does not damage our reputation or take advantage of it.

You must not establish a link in a way that suggests any association, approval, partnership, verification, endorsement or sponsorship by CarZoon where none exists.

You must not frame our site on any other website, create misleading deep links, use our branding without permission, or link from any website that contains unlawful, harmful, misleading, offensive or inappropriate content.

We reserve the right to withdraw linking permission without notice.

17. Third-party links and resources

Where our site contains links to other websites, services, tools, APIs, finance providers, warranty providers, insurance providers, history check providers, valuation providers, payment providers, mapping providers, social media platforms or other third-party resources, these are provided for information and convenience only.

We have no control over the content, availability, accuracy, security, policies or practices of third-party sites or services. Links should not be interpreted as approval or endorsement by CarZoon unless we clearly state otherwise.

18. Suspension and termination

We may suspend, restrict or terminate your access to the site, account, adverts, dealer profile or any feature if we reasonably believe that you have breached these terms, misused the site, provided false or misleading information, acted fraudulently, caused risk to users, failed required checks, failed to pay applicable fees, or damaged CarZoon, its users or its reputation.

Where appropriate, we may also remove adverts, disable enquiry forms, restrict contact features, suspend dealer status, withdraw badges or take any other action reasonably necessary to protect the site, users, CarZoon or third parties.

Action will be proportionate to the concern where reasonably possible. A person affected by a content or Account decision may use the Complaints Procedure, unless an appeal cannot be offered because of law, immediate safety, fraud prevention or security.

19. Applicable law and jurisdiction

These terms, their subject matter and their formation are governed by the laws of Scotland.

If you are a consumer, the courts of Scotland will have non-exclusive jurisdiction. If you live in England and Wales, Northern Ireland or another part of the United Kingdom, you may also be able to bring proceedings in the courts where you live.

If you are a business user, dealer or trade user, you and we agree to the exclusive jurisdiction of the courts of Scotland, unless we agree otherwise in writing or the law requires a different position.
